It is cxiiecttd that tho ease will bo on trial during the entire' week at least. This case is-me f seven suits which grew out of the ace ideiit w hich resulted in the death of three men and the loss of much property. This lirst case to come- to trial is expected to develop whether the blame for the accident lays on the cmtracter or on the lessee eif the building. It is agreed thus far on both sides that there is no blame whatever attached to W. W. Schnchier. the arc hitect who planned the alterations to tho building which were being made at the time of the accident. It is alleged by tho plaintiff that tho acchlent was due te negligence on the part of the and 1 cent store, while the defense is that the work of making the alterations was being done by an independent contractor, William Solarck, over which the 5 and 10 cent store had no contred. Shively is made a oarty to the suit because he was a sub-lessee eif the building. The buildin at No. 11- was owned by the Horner estate and tho building "at No. 114 by the Shivtly estate. Shlvely leased the basement and lirst Jloor of No. 114 to the 10 cent store which also secured the entire Heirncr building. The sceemd and thinl door of the Iloincr building was later leased by the 10 cent store to Shively and others, who thus became a party to the contract when Long Mye cxtomled his lease on the secemd lleior. It was when the wall between the lirst floors of the two buildings was be'incr removed for the 7 and lo c nt stere that the cedlapse of the building occurred.
