Mitchell to be recorded and pro mni gated : tuc state or ixdiaxa) Appeal from vs the decision of William c. MiTcur.LL,) a Regimental Court-martial, (of which Lieutenant Col. Pcuet Harvey acted as president.) which met on the 25lh of October last, finding Captain William C. Mitchell guilty of "unolficer like conduct," came before William C. Keen, at his Head Quarters, on the 16th of December. 1 133.5. for his final decision. The point relied upon by said appellant were as follows: 1. That the court ruled him into (rial, when he had never been arrested. 2. The charges investigated, diiiering from the copy delivered to defendant. 3. Tne court receiving testimony on tiVoi charges not embraced in the original charges. 4. The court taxing the defendant with eots cf prosecution. With regard to the first point it does not appear from the record or any other evidence, that said defendant had ever been formally arrested. The re turn of t'ae Adjutant, on the back of the original allid ivit, being "executed by reading" but ibat objection i done away, by the personal appoar-tnee and pleadings (o the charges by the defendant; lints, placing himself in the custodv ol the court. 3 1 point this objection is trilling and beneath notice; the only variation being in one letter. 3d point This objection is not founded on facts the evidence of the witnesses objected to. was strictly legal going to hew other and similar acts of unoliicer -like conduct. 4th point Tiiis objection appears to be well taken costs of military pro-ecu! ions do not follow the conviction; fail ate to be paid in the special manner pointed out ia "the 73d section of the Mihtia Law of Indiana. Tae General discmers oilier informalities, which he believes he is bound lo notice. Firstly, the original charges were not sworn !o, in the manner pointed out in the Militia Law. Secondly, th" record of the icgimental court is without venue. It appears from that record that certain men, some with and s.une without military titles prefixed to their names met at the court-house i n Vevay upon a certain day named but does not say whether they belong to Kenfuekv. Ohio or Indiana nor by what .authority they met (here. Whereupon, after mature deliberation, the General adjudges that (he proceedings aforesaid, are informal, illegal and void that Cap!. William C.
