Counter AMdevlta Made Against the Motion For a New Trial. In the celebrated bank case, Needham vs. John C. Wright et al., the plaiutirts’ attorncya this morning filed a number of affidavits in answer to those made in support of the defendants’ motion for a new trial. In a general way F. A. W. Davis and J. L. Ketcham deny all the statements made by the affiants for the defense, regarding conversations with them (Davis and Ketcham) in which they are alleged to have acknowledged that the purchase of the First National stock was not for the Banking Company, and in addition to this they assign reason why those gentlemen who made the affidavits, Messrs. Samuel Hanwny, Hubert Browning, I. N. Neeld, T. Edward Hambleton, Hume, Dickson, Howard and others, should be prejudiced against the Bonking Company and its interests. They claim that most of them had owed the concern money; that Mr, Browning was interested in the First National, and that Mr. Hainbleton was a business associate with and a personal friend of John C. New, and on these various accounts Messrs. Davis and Ketcham think that the affidavits of the others should not have great weight. A counter affidavit was made by John Tarlton, one of the jurors, who say’s be only bad trouble with Harrison’s Bank and was therefore not prejudiced against the First National. Daniel W. Heaton, dnother ot the jurors, swears that after the trial, tiample Eoftiu and he .had a talk about it and that Loftin said that several years ago lie had arranged to huy a ranch in Texas and that John C. New had promised to furnish him the money. When he came back from there, however, Mr. New "went back on him,” saying that he could not s|»are the money just then, as he had bought the First National Bank, but that as soon as he could “unload” the stock he would accommodate him. Mr. Loftin said that he subsequently understood that New had sold the stock to’the Indiana Ranking Company. To controvert the various statements made in the tormeraffidavits regarding memoranda made by Mr. Morrison, etc., George C. Duy makes an affidavit that ail such memoranda left by Morrison, regarding the bank purchase, came into his hands and were offered in evidence at the former trial, and Merrill Moores swear* that he called on Mrs. Morrison, and that she stated that she had no recollection of Mr. McCutcheon’s visit and consultation with her late husband. Alex. F. Morrison, a nephew, testifies that Mrs. Morrison refused to see the plaintiff’s counsel in the case. Win. Needham’s affidavit is to the effect that Morrison stated to him that the purchase of the bank stock was tor the Indiana Bunking Company, and that he subsequently stated that he was not satisfied witii it, as its value had been misrepresented to him. Jane M. Ketcham deposes that at the time of the purchase she was told by either Davis or one of her sons that it was made for the Banking Company; and Silas M. Shepherd, the attorney, admits to having “treated” three of the jurors to lemonade and cigars after the verdict was rendered. The argument on the motion for a new trial Will probably begin to-morrow.
