YVlllaril Carpenter vs. City of Evansville. An application was made to Judge Smith, sitting in chamber at Cannellon, on Friday, for an injunction against the city to restrain the City Collector from collecting the corporation taxes on the applicant's property, for the year 1837. Mr. Chandler, on behalf of the applicant, asked for the injunction on the grounds that the tax was illegally assessed, and that tho valuation of the property was unequal, unjust, and oppressive. He made the following points, viz: first, that tho property was appraised too highly; 2d, that the mode of appraising was ille gal; 3d, that the taxes exceeded by i seven cents the amount allowed by the charter to be assessed on each $100 valuation; and 4th, that the Collector had transcended the power given to him by the charter. Major Robinson, on the part of the city, contended that the assessment made by Mr. Burke, the city assessor, and subsequently revised by the Board of Equalization, was legal, just, and equal. He quoted the law, tho charter, and tha ordinances of the city, and sustained his positions by reference to various authoritiea. Ho. read a communication from Mr. Carpenter, in which tha latter had proposed to pay his taxes without further objections, if the City Council would order the payment of the coupons on the Lamasco bonds to the Straight Line Railroad. The case occupied "the attention of the Judge till a late hour io the evening. At the close of the argu ment, the J udge said as it was a matter of much importance to Mr. Carpenter and of deep interest to the city, ho desired time to consider the case, and would make an ord r on Thursday next, or as early as his other duties would enable him to rrive hi attention to the case. We learn D that it is likely, whatever may be the decision of Ju lg Smith, that an appea will be taken to the Supreme Court.
